Florida law separates "sparklers" — ground-based fountains, novelties, and wire sparklers — from "fireworks," meaning anything that launches into the air or explodes, like mortars, firecrackers, and rockets. Sparkler-type items have always been legal to use.
A 2020 update to state law (SB 140) created three "designated holidays" — July 4th, December 31st, and January 1st — when aerial and exploding fireworks can legally be used statewide.
That law doesn't override local ordinances or a legally recorded HOA covenant, so it's worth checking what applies where you'll be shooting.
This is general information, not legal advice — always confirm current local rules before your show.
July 4 · December 31 · January 1 — aerial & exploding fireworks allowed statewide.
Fountains, novelties, and wire sparklers are legal to use year-round in Florida.
City ordinances and recorded HOA covenants can still restrict use, even on a designated holiday.
